Terms of Service — Printly

1. About us
Printly ("Printly", "we", "us", "our") is a printing business operated by OnMedia, located at Vima Plaza, 2nd Floor, Muthiga, Nairobi, 00300, Kenya. These Terms govern all quotes, orders, and services provided by Printly. By requesting a quote, placing an order, or using this website, you agree to these Terms.
2. Quotes and pricing
All prices are in Kenyan Shillings (KES) and, unless stated otherwise, exclude VAT and delivery. Quotes are valid for 14 days from the date issued and may change after that period or if the specifications of your job change. A quote becomes a binding order only once you have confirmed it in writing and, where applicable, paid the required deposit.
3. Orders and artwork
You are responsible for supplying print-ready artwork in the formats we specify (e.g. PDF, at the correct resolution and dimensions) unless you have engaged us for design. You are responsible for checking the accuracy of all content you supply, including spelling, layout, images, contact details, and pricing. Printly is not liable for errors contained in artwork you have approved.
4. Proofs and approval
Where a proof is provided, printing will not begin until you have approved it. Approval is your confirmation that the file is correct and ready to print. Any errors discovered after you approve a proof, and any resulting reprint, are your responsibility and will be charged accordingly. If you waive a proof to save time, you accept the file as supplied.
5. Colour and material variation
Colours shown on a screen will not match printed output exactly, as screens and printing use different colour systems. Minor variation in colour, finish, cut, and positioning is an inherent part of printing, and slight differences may also occur between print runs of the same job. These variations are not defects and are not grounds for a refund or reprint.
6. Turnaround and delivery
Turnaround times we quote are estimates, calculated from the point of final artwork approval and cleared payment, and are not guaranteed. We are not liable for delays caused by late approval, incomplete files, payment delays, or events outside our reasonable control. Orders are available for collection at our premises or for delivery within Nairobi by arrangement; risk in the goods passes to you on collection or delivery.
7. Quantity tolerance
Due to the nature of print production, we may deliver up to 5% more or fewer items than the quantity ordered. Where a shortfall occurs, you will be charged only for the quantity delivered.
8. Payment
For custom and personalised orders we require a deposit before production begins, with the balance payable before collection or delivery unless credit terms have been agreed in writing. We reserve the right to withhold goods until payment is received in full.
9. Changes and cancellations
Once a job has entered production it cannot be cancelled or changed, and any deposit paid is non-refundable, as work and materials will already have been committed. If you request changes before production begins, revised pricing and timelines may apply.
10. Returns and refunds
Printed items are produced to your specification and are custom goods; they cannot be returned or refunded on the basis of change of mind. If an order is defective or does not match the specification you approved due to a fault on our part, notify us within 5 days of collection or delivery and we will reprint the affected items or provide an appropriate remedy. This does not affect any rights you have under applicable Kenyan consumer law.
11. Your content and intellectual property
By submitting artwork or content to us, you confirm that you own it or hold the rights and licences needed to reproduce it, and that printing it will not infringe any third party's rights or any law. You agree to indemnify Printly against any claim arising from the content you supply. You retain ownership of your own artwork; any design work created by Printly remains our property until paid for in full.
12. Limitation of liability
To the fullest extent permitted by law, Printly's total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, including loss of profit, business, or opportunity. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law.
13. Data protection
We handle your personal information in line with the Data Protection Act, 2019 (Kenya) and our Privacy Policy. We use the details you provide only to process quotes, orders, and related communication.
14. Governing law
These Terms are governed by the laws of Kenya, and any dispute will be subject to the jurisdiction of the courts of Kenya.
